DataSpice terms of service

The agreement between you and us when you use this service: what we provide, what you owe, what each of us may end, and what we are and are not responsible for.

Who you are agreeing with

These terms are between you and TOORX LTD, doing business as DataSpice, whose registered office is at 71-75 Shelton Street, London, WC2H 9JQ, United Kingdom. They apply when you open an account on dataspice.net or use the service in any way. If you are agreeing on behalf of a company, you confirm you may bind it.

The service

We provide analytics for websites and applications: a first-party tracker, integrations with services you already use, and an interface that reports what they measure. Interpretation generated by artificial intelligence is offered on some plans and is always presented separately from measured figures. It is an aid to reading your numbers, not a statement of fact about your business, and it should not be relied on alone for a decision that matters.

Your account

You are responsible for what happens under your account and for the people you invite into it. Tell us promptly if you believe someone else has access.

You must not use the service to collect data you have no right to collect, to measure a site you do not operate, to work around plan limits, or to attack, overload or reverse engineer the service. We may suspend an account that does, and will say why.

The trial, prices and payment

A trial runs for the period stated when it starts and requires no payment card. When it ends, access to the product is paused until a plan is bought. Nothing is deleted when a trial ends, and your data returns the moment you subscribe.

Plans are billed in advance for the period chosen, through our payment provider. Prices are those shown at the time you buy. If we change a price, the change applies from your next renewal and we will tell you before it does. Taxes are added where the law requires.

Cancel at any time and the plan runs to the end of the period already paid for. We do not refund part-periods except where the law gives you that right or where we have clearly failed to provide the service.

Your data belongs to you

Everything you collect through the service remains yours. We use it to operate the service for you and for nothing else: we do not sell it, do not share it with advertisers, and do not use one customer’s data to build a product for another. You may export it and you may delete it.

You are responsible for having the right to collect what you collect, and for telling the people you measure what you are doing, in the way your own law requires.

Availability

We work to keep the service available and we do not promise it always will be. Maintenance, provider failures and events outside our control all happen. Where we have agreed a separate service level in writing, that agreement governs instead of this paragraph.

What we are responsible for

We provide the service with reasonable care and skill. To the extent the law allows, we are not liable for lost profit, lost revenue, lost data, or indirect or consequential loss, and our total liability in any twelve-month period is limited to the amount you paid us in that period.

Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, and for fraud.

Ending the agreement

You may close your account at any time. We may end this agreement with thirty days’ notice, or immediately if you breach these terms in a way that is serious or that you do not fix after we ask.

When the agreement ends you may export your data for thirty days, after which it is deleted.

Changes to these terms

We may change these terms. For changes that affect you materially we will give at least thirty days’ notice by email, and if you do not accept them you may cancel before they take effect without penalty.

Law and disputes

These terms are governed by the law of England and Wales, and its courts have jurisdiction. If you are a consumer, this does not remove the protection of the law of the country you live in.
